General Terms and Conditions
§ 1 Basic Provisions
- The following terms and conditions apply to all contracts you conclude with us as the provider (lemonwax OHG) via the website lemonwax.de. Unless otherwise agreed, any terms and conditions you may use are expressly rejected.
- A consumer within the meaning of these regulations is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity. An entrepreneur is any natural or legal person, or a legally capable partnership, acting in the exercise of their independent professional or commercial activity when concluding a legal transaction.
§ 2 Conclusion of Contract
- The subject of the contract is the sale of goods.
- By listing the respective product on our website, we submit a binding offer to conclude a contract under the conditions specified in the product description.
- The contract is concluded via the online shopping cart system as follows:
- Items intended for purchase are placed in the "shopping cart."
- Using the corresponding button in the navigation bar, you can access the shopping cart and make changes at any time.
- After accessing the "checkout" page and entering personal, payment, and shipping details, all order information is displayed again on the order overview page.
- If you use an instant payment system (e.g., PayPal / PayPal Express / PayPal Plus, Amazon Payments, Postpay, Sofortüberweisung), you will either be redirected to the order overview page or first to the website of the payment provider. After completing the payment there, you are returned to the order overview page in our online shop.
- Before submitting your order, you can review and modify all information or cancel the purchase. By clicking “payable order” you legally accept the offer, thereby concluding the contract.
§ 3 Right of Retention and Retention of Title
- You may only exercise a right of retention if it concerns claims arising from the same contractual relationship.
- The goods remain our property until full payment of the purchase price.
- If you are an entrepreneur, the following applies additionally:
- We retain ownership until full settlement of all claims arising from the ongoing business relationship. Pledging or assigning goods as security is not permitted before ownership passes.
- You may resell the goods in the ordinary course of business. In this case, you assign to us all claims from resale equal to the invoice amount. You remain authorized to collect the claims unless you fail to meet your payment obligations.
- If the reserved goods are mixed or combined with other items, we acquire co-ownership of the new item proportional to the invoice value of the reserved goods.
- We commit to releasing securities upon request if the realizable value exceeds the secured claim by more than 10%. The choice of securities to release is at our discretion.
§ 4 Warranty
- Statutory rights for defects apply.
- If you are an entrepreneur, the following deviations apply:
- Only our specifications and the manufacturer’s product description are considered agreed characteristics; other advertising or public statements are not.
- You must inspect the goods immediately and notify us of obvious defects within 7 days of receipt in text form (e.g., email). This also applies to hidden defects upon discovery. Failure to inspect or report excludes warranty claims.
- In case of defects, we choose to remedy or replace. If the remedy fails, you may reduce the price or withdraw from the contract. A second failed attempt generally counts as unsuccessful. Additional costs from transporting goods to another location than the place of performance need not be borne by us, unless necessary for proper use.
- The warranty period is one year from delivery. Exceptions apply for damages caused by injury to life, body, or health, or for grossly negligent or intentional damages.
§ 5 Liability
- We are fully liable for damages from injury to life, body, or health. Liability also applies without limitation for intent, gross negligence, fraudulent concealment of defects, guarantees, and other legally defined cases.
- Liability for defects under statutory warranty is as defined in Part II (Customer Information).
- For essential contractual obligations, liability for slight negligence is limited to typical, foreseeable damage. Essential obligations are those necessary to achieve the purpose of the contract.
- For minor contractual breaches, liability for slight negligence is excluded.
- Internet communication cannot be guaranteed to be error-free or continuously available. We are not liable for uninterrupted availability of the website or services.
§ 6 Governing Law, Place of Performance, Jurisdiction
- German law applies. For consumers, this choice of law applies only if it does not remove the protection guaranteed by the mandatory law of the consumer’s country of residence (principle of favorability).
- Place of performance and jurisdiction is our registered office, unless you are a consumer. Exceptions apply if no general jurisdiction exists in Germany or the EU, or residence is unknown. The right to sue at another legal venue remains unaffected.
- The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

- Delivery Conditions
- Delivery conditions, delivery dates, and restrictions are provided on the website or offer.
- For consumers, the risk of accidental loss or deterioration passes upon delivery to you. For entrepreneurs, delivery and shipment are at your risk.
- Statutory Warranty
- Warranty follows Part I, § 4.
- Consumers are asked to check goods upon delivery for completeness, obvious defects, or transport damage and notify us or the carrier immediately. Failure does not affect statutory rights.
